Terms and Conditions of Use for Go-Bike

Welcome to Go-Bike, a mobile application provided by BlossomEdge ltd ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Go-Bike application and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.

1. Acceptance of Terms

By creating an account and using the Go-Bike Service, you represent that you are at least 16 years old (or the minimum age required by applicable law in your jurisdiction), and you agree to these Terms. If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf. Your agreement forms a legally binding contract between you and BlossomEdge ltd.

2. The Go-Bike Service

Go-Bike is a mobile application that supports cyclist and e-scooter rider safety by providing real-time collision risk warnings and recording near-miss events based on on-device computer vision processing. Go-Bike also collects ride data (as described in Section 4) which may be used by BlossomEdge and shared with third parties for cycling safety and urban mobility purposes, as described in Section 5.

THE GO-BIKE SERVICE IS INTENDED AS AN AID ONLY. IT IS NOT A SUBSTITUTE FOR CAREFUL CYCLING, ADHERENCE TO ALL TRAFFIC LAWS, OR CONSTANT VIGILANCE. YOU ACKNOWLEDGE THAT THE APP MAY FAIL TO DETECT HAZARDS, MAY PROVIDE FALSE ALERTS, AND MAY MALFUNCTION. WE ARE NOT RESPONSIBLE FOR ANY ACCIDENTS, INJURIES, OR DAMAGES RESULTING FROM YOUR USE OF THE APP, RELIANCE ON ITS ALERTS, OR ITS FAILURE TO ALERT YOU.

3. Account Registration and Security

3.1. Registration: You agree to provide accurate, current, and complete information during the registration process.

3.2. Account Security: You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Permissions and Data Collection

4.1. Required Permissions: Use of the core collision detection functionality requires you to grant the Service permissions to access:

Ride Data Collected: During each ride, the Service collects the following data locally on your device: GPS location and timestamps, inertial measurement data (accelerometer, gyroscope), short video clips around detected events, and any outputs derived from these data by the computer vision and risk models used.

If you opt in to data sharing (see Section 4.4), an anonymous identifier is also assigned to your ride data. This identifier allows multiple rides to be analysed together but cannot be used to identify you personally and is not linked to your email address, account, or any other personal information.

All data is stored on your device. You can review and delete all locally stored data at any time through the app.

4.3. Cloud Upload: You may choose to upload ride data from your device to our cloud service. Uploaded data is used to provide and improve the Service, and may be anonymised and aggregated by BlossomEdge. The use and sharing of your data with third parties is governed by the licence in Section 5.2 and, where applicable, by the additional consents described in Section 4.4.

4.4. Additional Data Sharing Consents: In addition to the data sharing rights granted under Section 5.2, you may be asked to provide separate, specific consents within the app for additional data uses — such as sharing ride-level data for cycling safety and urban mobility purposes, or sharing data with specific partner organisations. These consents are voluntary, granular, and can be withdrawn at any time. The scope and details of each consent are presented at the point where consent is requested. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal, nor does it affect the sharing of anonymised or de-identified data under Section 5.2.

4.5. Anonymisation and Privacy Measures: Video clips are processed to blur faces and licence plates before being shared with any third party. BlossomEdge takes reasonable technical and organisational measures to ensure that data shared with third parties cannot reasonably be used to identify you. You may share unblurred video clips stored on your device with others at your own discretion; BlossomEdge is not responsible for any such sharing by you.

4.6. Data Retention and Deletion: Data stored locally on your device remains under your control and can be deleted at any time. Cloud-stored data associated with your account will be deleted upon account deletion or upon your request. Anonymised, aggregated data that can no longer reasonably be used to identify you may be retained indefinitely, as it is no longer personal data.

5. Intellectual Property

5.1. Our Rights: The Service and its original content, features, and functionality are and will remain the exclusive property of BlossomEdge ltd.

5.2. Licence to Uploaded Data: You grant BlossomEdge ltd a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, process, and create derivative works from your uploaded ride data for the purpose of providing and improving the Service and for cycling safety and urban mobility purposes, including sharing anonymised or aggregated data derived from your rides with third parties and making such data publicly available. This licence survives termination of your account with respect to anonymised data that can no longer reasonably be used to identify you.

6. Prohibited Conduct

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the Service. Prohibited activities include, but are not limited to:

7.1. Collision Detection Reliability: The collision detection feature relies on multiple factors, including your device's hardware performance, ambient light conditions, camera clarity, GPS signal strength, and the accuracy of the on-device AI. The Service is not guaranteed to detect all potential collisions or near-misses.

7.2. Service "As Is": Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

In no event shall BlossomEdge ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and request account deletion. Upon account deletion, all personal data stored in our cloud systems will be deleted in accordance with Section 4.6.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom (England and Wales), without regard to its conflict of law provisions. If you are a consumer habitually resident in the European Union, you additionally benefit from any mandatory provisions of the consumer protection laws of your country of residence.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
